Welcome to TailorWear (www.tailorwear.in), a brand operated by Indoglobal Lifestyle Ventures Private Limited (CIN: U17299MH2022PTC376948), a company incorporated under the laws of India and having its registered office in Mumbai, India (hereinafter referred to as “TailorWear”, “ILVPL”, “we”, “our”, or “us”).

These Terms of Service (“Terms”) govern your access to and use of the TailorWear website, mobile applications, digital platforms, consultations, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Services.

1. Definitions & Interpretation

  • “Client” / “You” means any user, customer, or visitor accessing the Services.
  • “Bespoke / Made-to-Measure / Custom” refers to garments created specifically based on individual measurements, preferences, and consultations.
  • “Production Phase” means the stage at which fabric cutting, stitching, or irreversible preparation has commenced.
  • “Manufacturing Defect” means a demonstrable flaw in construction or workmanship, excluding natural material variation or subjective preference.

Headings are for convenience only and do not affect interpretation.

2. Eligibility & User Responsibility

You represent and warrant that:

  • You are legally competent to enter into a binding contract.
  • All information, measurements, images, and instructions provided by you are accurate and complete.
  • Where Services involve minors, a legal guardian provides consent and remains responsible for all instructions and data supplied.

TailorWear shall not be responsible for errors arising from inaccurate or incomplete information provided by you.

3. Use of the Services

You are granted a limited, revocable, non-exclusive license to access and use the Services for lawful, personal, and non-commercial purposes.

You shall not:

  • Copy, reproduce, distribute, or exploit any content without written consent.
  • Use automated tools, scraping, or data extraction methods.
  • Interfere with the security or operation of the Services.
  • Upload or transmit unlawful, infringing, defamatory, or harmful content.

We reserve the right to suspend or terminate access for violations.

4. Intellectual Property

All content, designs, illustrations, images, text, software, and brand elements are the exclusive property of TailorWear or its licensors.

No rights are granted except as expressly stated. Unauthorized use may result in legal action.

5. Bespoke & Custom Commissions

5.1 Nature of Bespoke Services

All TailorWear garments are handcrafted to individual specifications and are non-resalable.

5.2 Fit & Adjustments

  • TailorWear offers a limited adjustment window to address genuine construction or measurement issues attributable to TailorWear.
  • This does not cover:
    • Weight or body changes after measurement
    • Preference changes
    • Styling expectations not agreed during consultation
  • The number and scope of adjustments are determined by TailorWear.

5.3 Fabric & Material Characteristics

Natural fabrics may exhibit minor variations in shade, texture, or weave. These are inherent qualities and not defects.

6. Orders, Timelines & Delivery

  • Production and delivery timelines are estimates, not guarantees.
  • Delays may occur due to fabric sourcing, logistics, customs, force majeure, or client non-responsiveness.
  • TailorWear shall not be liable for indirect or consequential losses due to delays.

International customers are responsible for customs duties, taxes, and import compliance.

7. Cancellations, Returns & Refunds

7.1 Cancellations by Client

  • Orders may be cancelled only before entering the Production Phase.
  • Once production begins, cancellation is not permitted.

7.2 Cancellations by TailorWear

We reserve the right to cancel orders due to errors, unavailability, or operational constraints, with a full refund where applicable.

7.3 Returns

Due to the bespoke nature of garments, returns or exchanges are not accepted unless a Manufacturing Defect is confirmed by TailorWear.

7.4 Refund Processing

Approved refunds are issued via the original payment method within a reasonable period, subject to payment gateway timelines.

8. Payments & Fraud

Payments are processed via third-party gateways. TailorWear does not store payment credentials.

We reserve the right to:

  • Refuse or cancel suspicious transactions
  • Recover losses arising from fraudulent activity
  • Initiate legal proceedings where necessary

9. Typographical Errors & Pricing

We reserve the right to correct errors in pricing or descriptions and to cancel affected orders with appropriate refunds.

10. Electronic Communications

By using the Services, you consent to receive electronic communications, including emails, SMS, WhatsApp, and system notifications.

11. User-Submitted Content

You represent that you own or have rights to any content you submit (photos, measurements, messages).

You grant TailorWear a limited license to store, process, and use such content solely for service delivery, analysis, and internal reference.

12. AI, Digital Tools & Representations

TailorWear may use automated systems and AI for:

  • Fit suggestions
  • Recommendations
  • Fraud detection
  • Content and analytics

Digital previews, illustrations, or simulations are indicative only. Final garments may vary within acceptable bespoke tolerances.

13. Limitation of Liability

To the maximum extent permitted by law:

  • TailorWear shall not be liable for indirect, incidental, or consequential damages.
  • Total liability shall not exceed the amount paid by you for the specific order giving rise to the claim.

14. Indemnity

You agree to indemnify and hold TailorWear harmless from claims arising out of your breach of these Terms, misuse of Services, or violation of law.

15. Force Majeure

TailorWear shall not be liable for failure or delay caused by events beyond reasonable control, including natural disasters, government actions, supply chain disruptions, or pandemics.

16. Suspension & Termination

We may suspend or terminate access to Services at our discretion, without liability, for breach, abuse, or operational reasons.

17. Third-Party Services

TailorWear is not responsible for failures or actions of third-party providers including payment gateways, couriers, or platforms.

18. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Courts in Mumbai shall have exclusive jurisdiction.

19. Modifications

We may update these Terms from time to time. Continued use constitutes acceptance of revised Terms.

20. Severability

If any provision is held invalid, the remaining provisions shall remain enforceable.
